Real Estate Appropriation Our firm has significant experience in appropriations of real property. We have successfully prosecuted appropriation actions on behalf of several public entities, including the City of Huber Heights, the City of Kettering and Miami Valley RTA (nka Greater Dayton RTA). We routinely handle appropriation actions involving acquisition of easement areas for such purposes as installation of electric trolley lines, water, sewer and storm drainage systems and public road right-of-way projects. We have also handled extremely sophisticated appropriations projects involving multiple properties and utility systems. For example, we very successfully prosecuted the appropriation of Ohio Suburban Water Company on behalf of the City of Huber Heights several years ago and have handled major appropriations on behalf of municipalities in connection with significant road right-of-way improvement projects. We also have broad experience in the defense of appropriation actions on behalf of private sector clients, and have enjoyed considerable success in achieving maximum value for these clients. We have several attorneys in our office with extensive experience in appropriations actions. As cases arise, we typically assemble a team consisting of a litigation attorney and a real estate/public sector attorney. We also rely upon litigation and real estate paralegals to assist with the procedural aspects of each case and utilize associate attorneys where appropriate to effectively manage fees.
