For well over a century, Coolidge Wall Co., L.P.A. has been actively involved in assisting employers in labor and employment matters. What began as a service to the firm’s corporate clients has evolved into a cornerstone of the firm’s continued success. Each day, the attorneys that make up Coolidge Wall's labor and employment law department assist the firm’s clients in navigating the ever-changing field of labor and employment law. The department is a proactive problem solver. The attorneys not only work to resolve the immediate matter, but seek to assist the client in understanding and addressing any underlying issues which may exist. Many of the attorneys in the department have extensive in-house legal experience and are well versed in handling matters from a broad-based business perspective, rather than a narrow legal focus.
While the labor and employment department takes great pride in the preventative services it offers, from drafting employee handbooks to training employees and supervisors regarding issues such as sexual harassment and occupational health and safety, the department is equally adept at defending employers when they face a legal challenge, be it from an administrative agency, another company, or a current or former employee.
Not only do the department’s attorneys stay abreast of changes to employment and labor laws through participation in seminars and conferences, the department’s attorneys are regular presenters at seminars at the national, state and local levels. The attorneys’ involvement in these functions, as well as their collective experience in a wide variety of cases and situations, places them at the forefront of the labor and employment field.
Our labor and employment department also has a substantial workers' compensation practice. These attorney devote a significant portion of their time defending workers' compensation claims before the Bureau of Workers' Compensation and the Industrial Commission of Ohio for both state-funded and self-insured employers.
Our attorneys become involved at all levels of the administrative process; however, early attorney involvement often allows for a better defense. This involvement can include gathering medical records, preparing witness statements, compiling employment records and accident investigations, and acquiring expert opinions supporting the defense of the claim.
Although Third-Party Administrators often represent companies at the administrative level, Third-Party Administrators are not permitted to make legal arguments or cross-examine witnesses during the hearings. However, attorneys are not limited in those areas, and the workers' compensation and safety attorneys of Coolidge Wall have successfully defended workers' compensation claims at the administrative level both by cross-examining witnesses and making legal arguments.
The labor and employment department also has an employee benefits section which provides legal services in all aspects of benefit planning including:
- qualified and nonqualified retirement plans,
- health and welfare plans,
- cafeteria plans,
- deferred compensation agreements, and
- litigation relating to all types of employee benefit plans.
