News Release 7/24/07 Labor and Employment Team Wins Another Union Election The Labor and Employment Law Section of the Firm just posted another win in a union election conducted at a client's facilities in Oregon and Idaho. This election and the events leading up to it offer a text book example of creative union avoidance techniques. The union initially attempted to organize a single facility in Portland where the union had significant support. The Labor and Employment law team of Mark Kingseed and Laura Wilson, after examining the client's business operations, objected to the Oregon unit and argued that due to overlapping management control and identical employee duties, two other facilities should be added to the proposed bargaining unit. After a hearing, the National Labor Relations Board ruled in the company's favor and expanded the proposed bargaining unit to include another facility in Oregon and one in Idaho. The union was decisively defeated in the election held in the expanded three facility bargaining unit. The Labor and Employment Law team at Coolidge Wall is experienced in all aspects of union/company relationships, including union avoidance training, conducting elections, handling grievance and arbitration hearings and conducting collective bargaining negotiations for those clients with existing union agreements.
